The Urgency of Integrating Domestic Violence and Early Marriage Prevention Policies: Implementation in Indonesia

Abstract

Child marriage and domestic violence (DV) remain structural problems in Indonesia despite the enactment of various regulations, including the Marriage Law No. 16/2019, the Sexual Violence Crime Law No. 12/2022, and the Elimination of Domestic Violence Law No. 23/2004. This article argues that preventing early marriage and preventing DV should not be viewed as separate agendas, but rather should be integrated into public policy design, particularly through reform of marriage dispensation mechanisms, monitoring of unregistered marriages, and mainstreaming gender equality-based and anti-violence education in educational institutions. Based on a review of international and national literature on the link between child marriage and DV and a normative analysis of the regulatory framework and data from the National Commission on Violence Against Women, this article demonstrates that regulatory gaps, suboptimal law enforcement, and a strong patriarchal culture exacerbate the vulnerability of women and children to violence. The analysis then proposes a policy integration model that places child marriage prevention as an upstream strategy for preventing domestic violence, through tightening multi-party marriage dispensations, strengthening the marriage reporting and registration system, and integrating child marriage and domestic violence prevention modules into the national curriculum in line with SDGs 5 and 16 agendas.
